Under the Fair Work Act 2009 (the FW Act), employers, unions and other bargaining representatives must comply with the good faith bargaining requirements in relation to a proposed enterprise agreement.

Employees may take protected industrial action in support of claims in the context of bargaining, and employers may respond with protected industrial action in the form of lockouts.
